Terms of Service - Consumers
This Consumer Agreement ("Agreement") is entered into between Nousattva Pty Ltd ("Nousattva", "we", "us", or "our"), an Australian proprietary limited company, and the individual consumer ("Consumer", "you", or "your") who accesses or uses the ResQBox Food platform ("ResQBox Food", "Platform"). By registering, accessing, or using the Platform, you agree to be bound by the terms and conditions set out below.
1. Purpose of the Platform
1.1 ResQBox Food is a digital marketplace operated by Nousattva that enables Consumers to purchase surplus food boxes listed by participating restaurants and food vendors ("Vendors").
1.2 Nousattva acts solely as a facilitator and does not prepare, own, store, or manage any food listed on the Platform.
2. Account Registration
2.1 To use the Platform, you must:
- Be at least 18 years of age or have the consent of a parent or legal guardian;
- Provide accurate and complete registration information (including but not limited to full name, email address, and mobile number);
- Maintain the confidentiality of your account credentials; and
- Notify Nousattva immediately of any unauthorized access to your account.
2.2 Nousattva reserves the right to suspend or terminate your account for any misuse, breach of this Agreement, or unlawful activity.
3. Location Services
3.1 Upon logging into the Platform, you may be prompted to enable location services on your device.
3.2 Location data is used to:
- Display nearby Vendors who have listed surplus food boxes;
- Provide accurate pickup location details and estimated travel distances; and
- Improve search relevance and user experience.
3.3 You may decline location access; however, certain features of the Platform may be limited.
3.4 Location data is handled in accordance with Nousattva's Privacy Policy.
4. Ordering and Payment
4.1 Orders must be placed through the Platform using approved payment methods.
4.2 Payment Processing:
- Nousattva utilizes Stripe for secure payment processing.
- By placing an order, you agree to Stripe's terms of service.
- Nousattva does not collect, store, or view your full credit card or banking details.
4.3 Full payment is required at the time of order placement.
4.4 You will receive a digital confirmation and order reference number upon successful payment.
4.5 All orders are subject to Vendor acceptance. If an order is rejected, a full refund will be issued.
5. Pickup and Collection
5.1 You must collect your order from the Vendor within the designated pickup window.
5.2 You are required to present your order reference number at the time of collection.
5.3 If you fail to collect your order, the Vendor may mark the order as "Not Collected" and you may not be eligible for a refund.
5.4 At the Vendor's sole discretion, the same order may be provided to you on a later date without additional charge, provided you submit a request through ResQBox Food.
6. Cancellations and Refunds
6.1 You may cancel an order prior to Vendor acceptance. Once accepted, cancellation is subject to Vendor approval.
6.2 If a Vendor cancels your order, you will receive a full refund.
6.3 Refunds are issued at Nousattva's discretion and may be granted for:
- Incorrect or misleading listings;
- Food safety concerns; or
- Vendor cancellation.
6.4 Refunds will be processed to your original payment method via Stripe.
7. Consumer Obligations
7.1 You agree to:
- Use the Platform lawfully and respectfully;
- Not engage in fraudulent, abusive, or disruptive conduct;
- Provide honest feedback and report issues through official channels; and
- Comply with Vendor pickup instructions and timeframes.
8. Platform Limitations
8.1 Nousattva does not:
- Guarantee the quality, safety, or suitability of food listed by Vendors;
- Endorse or verify Vendor claims; or
- Assume liability for food-related incidents, delays, or disputes.
8.2 All food-related concerns should be directed to the Vendor. Nousattva may assist in dispute resolution but is not responsible for Vendor conduct.
9. Data Privacy
9.1 Nousattva collects and processes personal data in accordance with the Privacy Act 1988 (Cth).
9.2 Payment Security: All financial transactions are secured by Stripe. Nousattva does not hold sensitive financial data.

10. Intellectual Property
10.1 All content, branding, software, and listings on the Platform are owned or licensed by Nousattva.
10.2 You may not copy, reproduce, modify, or distribute any part of the Platform without prior written consent.
11. Termination
11.1 Nousattva may suspend or terminate your account immediately for:
- Breach of this Agreement;
- Fraudulent or abusive behavior; or
- Violation of applicable laws or regulations.
12. Governing Law
12.1 This Agreement is governed by the laws of the Commonwealth of Australia.
12.2 Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
13. Amendments
13.1 Nousattva may amend this Agreement at any time.
13.2 You will be notified of changes via the Platform. Continued use of the Platform constitutes acceptance of the amended Terms.
